Warranty conditions

No warranty claims can be made:

• without the original Dailyride receipt;
• with regard to E-bikes purchased from a third party, such as a (professional) intermediary.

The bolts of the Fatbike must be tightened again after every 50, 100 and 200 km.

Dailyride provides a guarantee for material, manufacturing and assembly errors in respect of the E-bike. The guarantee includes all components that ensure that the E-bike is operational, with the exception of the wearing parts. The following parts of the E-bike are in any case subject to wear ('wearing parts'): chain or belt, derailleur and derailleur wheels, sprockets, inner and outer tyres, handles, lamps, brake pads and brake discs, brake fluid, saddle, pedals, quick-release fasteners and paint.

Dailyride cannot guarantee that the E-bike can always be used without interruption, nor can it guarantee optimum riding comfort. Ease of use and riding comfort are (partly) dependent on factors that Dailyride has no control over, including the personal choice(s) of the consumer or weather conditions.

The warranty period commences on the delivery date as stated on the original delivery note of the relevant E-bike.

In addition to the statutory warranty on new E-bikes, a general warranty of 6 months applies to newly purchased parts.

Provided that the warranty conditions as referred to in this article 7 are met, Dailyride will repair or replace the defective part in such a way that the E-bike is operational again in the reasonable opinion of Dailyride. Dailyride can replace a defective part with an equivalent, non-defective part. This may also mean that the replacement part is not new, but used or refurbished.

The warranty will lapse: – In the event of irresponsible, reckless, incorrect, unskilled or improper use of the E-bike. This is the case, among other things, if the E-bike has been used for purposes other than daily personal use (including commercial rental, competitions, etc.) or if the instructions have not been followed; – When a defect or damage cannot be attributed to Dailyride. This is the case, for example, in the event of damage resulting from a fall, collision or the E-bike ending up in water; – If the E-bike (or parts thereof) has been repaired, modified and/or overhauled by someone other than Dailyride, or when original parts have been replaced by unofficial parts. In this case, all warranty or other rights with respect to the entire E-bike may lapse; – When the E-bike has not been maintained or has not been maintained in accordance with the maintenance obligation (sections 11, 12 and 13); – If the reporting obligation has not been met (section 14); – After the relevant warranty period has expired.

The E-bike must be maintained in accordance with the manual.

Warranty and service work is carried out at home using the Dailyride service instructions or is carried out by the mobile service bus or in the Dailyride workshop. The consumer is responsible for making (timely) appointments. Dailyride alone determines whether warranty or service work is carried out outside a Dailyride, on location. Article 9 paragraph 4 applies accordingly to the cancellation or rescheduling of appointments.

Defects or damage that affect the functioning of the E-bike must be reported to Dailyride immediately – and in any case within 48 hours of discovery. A telephone report must be confirmed in writing (which also includes e-mail) within three (3) working days. The report must contain at least the following information: purchase receipt, date of purchase, date of defect/damage and the possible cause of the defect or damage.

If parts are so defective or damaged that they have become (partially) detached from the E-bike, these loose parts must be carefully stored until the next time they can be handed over to Dailyride.

If there is a legal guarantee, Dailyride will send replacement parts with clear replacement instructions or will carry them out for the consumer free of charge. For non-legal guarantees, Dailyride is not obliged to undertake the repair. The consumer is in any case responsible for carrying out the service.

If Dailyride determines after investigation that no or limited warranty applies, Dailyride is entitled to charge all costs associated with the repair and/or replacement, including the investigation costs.

At the discretion of Dailyride, any part that Dailyride replaces during a repair or service may automatically become its property. Dailyride is not liable for any compensation for this.

Any use of the E-bike after a defect or damage has been found is at the expense and risk of the consumer or user of the E-bike; Dailyride is not responsible or liable for (further) damage resulting from this use. Liability of Dailyride for indirect or consequential damage, including loss of income, immaterial damage, loss of use is excluded. The limitations of liability included in this section 19 do not apply in the event of intent or deliberate recklessness on the part of Dailyride.

ARTICLE 8 – SERVICE AND WARRANTY

  1. The warranty conditions as referred to in this article 7 apply to new electric bicycles ('E-bikes') that a consumer has purchased directly from Dailyride or via one of the Dailyride partners.
  2. No warranty claims can be made: • without the original purchase receipt from Dailyride; • with regard to E-bikes purchased from a third party, such as a (professional) intermediary.
  3. For showroom models or second-hand E-bikes, a limited warranty of twelve (12) months or 500 kilometers applies. This warranty applies to consumers only.
  4. Dailyride provides a guarantee for material, manufacturing and assembly errors in the E-bike. The guarantee includes all components that ensure that the E-bike is operational, with the exception of the wearing parts (clause 9).
  5. Dailyride cannot guarantee that the E-bike can always be used without interruption, nor can it guarantee optimum riding comfort. Ease of use and riding comfort are (partly) dependent on factors that Dailyride has no control over, including the personal choice(s) of the consumer or weather conditions.
